Whiplash and the Low Speed Rear-Impact Collision

Welcome, to the only classes in all of western Canada specifically directed at Whiplash with a particular emphasis on the Low Speed Rear-Impact Collision (LOSRIC)! Said collisions make up ~70% of all ICBC claims, and they don’t take them lightly! Think the professionals you are dealing with, healthcare provider(s), insurance representative, lawyers, etc. are up on all the latest information covering this topic, think again. After attending this class you will quite literally be able to interview any of the above mentioned people involved in your claim!
Dr. Frank McDiarmid, FRCCSS(Canada) has been presenting these classes for a number of years, and they continue to evolve as new information becomes available. Therefore, if you’ve participated in an earlier class, you are most welcome to participate again, either on a refresher basis or to update yourself on this ever changing area of interest.
The classes are of such a standard they are accredited  for Continuing  Education  (1 credit for each hour of instruction) with the College of Massage Therapists of British Columbia (CMTBC) and the BC Association of Kinesiologists (BCAK) and the BC College of Chiropractors (BCCC). These classes are the abbreviated version, ~90 minutes long. The in-depth version, offered to specialty groups, i.e. healthcare providers, members of the legal profession, etc., average 6-9 hours in duration! Needless to say, Dr. McDiarmid  attempts to deal only with the most pertinent points that you are interested in. Also, just before each class he polls the audience to see what additional areas/topics I should cover, i.e. common insurance settlement tactics, an independent assessment was performed and they say your pain is not related the collision, all the tests are negative and no one can find anything, how to interview a prospective lawyer for your case, etc.

Below are a number of different areas that can be covered in the class, followed by a map to the library.   Members of the legal profession are welcome to bring along materials they have issue with  (re. reports by others, imaging reports, issues of contention, etc.) as Dr. McDiarmid is happy to review them with you, both plaintiff and defence , something newly minted lawyers just wetting their feet in the personal injury pool have found most helpful.  So, if your tired of feeling like  a coerced victim, and wish to know what the science and facts are, then join us.

Areas of discussion can include:

  • Exactly how it happens and why this type of injury is unique unto itself.
  • X-rays v. CT Scans  v. MRIs; when they’re required and what each can and can’t tell you.
  • Acute v. chronic pain. They aren’t the same!
  • Your options;  re. types of care & factors to consider when contemplating a settlement.
  • How to choose a lawyer. Specific questions to ask so you can literally interview them.
  • If you have been in 2 collisions, how to ‘Apportion’ how much each is responsible for.
  • Superficial v. thorough examination and how to tell the difference.
  • There is no minimal crash velocity/speed that applies when it comes to having been injured. In other words, crash testing has resulted in injuries with collision speeds less that 3 mph.
  • Insurance guidelines; how they’re misused, how to use them and how to tell the difference.
  • All your tests are negative (ie. X-rays, etc.), they can’t find anything wrong with you, you are in allot of pain/disability, you don’t know what to do and no one seems that interested in helping.
  • Your records and rights. You have 100% access to a copy, except in certain circumstances.
  • Injury risk factors. Literally a checklist identifying those at risk for acute v. chronic pain.
  • Injuries commonly missed, and exactly what tissues are commonly injured.
  • ‘Waste basket’ diagnoses like ‘soft tissue injury’, ‘muscle spasm’, etc. are discussed.
  • Caregivers - who’s trained and who’s not and how to tell the difference.
  • Treatments and therapies: what helps, what doesn’t and how to tell the difference.
  • The insurer has hired a mechanical engineer/Accident Crash Reconstructionist to review your case and low and behold they say you could not have been injured.
  • The insurer has sent you for an Independent Medical Examination and what should be in it.
  • Tactics commonly utilized to minimize your claim, where you quite literally do all the leg work.
  • A picture is worth a thousand words. Dr. McDiarmid will diagram chronic pain-as done in court.
